The provisions in this Section 3 are required by U.S. mobile carriers under the A2P 10DLC framework and constitute our binding commitment to you regarding SMS data practices.
3.1 How We Collect SMS Opt-In Consent
We collect your mobile phone number and SMS consent through the following methods:
- The public Sign Up modal at BatchExchange.com, including standard company signup and invite-key signup
- The customer contract signature page at BatchExchange.com/contracts/share, when a customer opens a secure contract link and checks the SMS consent box before digitally signing
At each opt-in point, we present: (a) clear disclosure that you are consenting to receive SMS messages; (b) the types of messages you will receive; (c) message frequency disclosure; (d) "Msg & data rates may apply" notice; (e) HELP and STOP instructions; and (f) links to this Privacy Policy and our Terms of Service. SMS consent is not required to create an account, purchase services, or sign a contract.

3.2 Types of SMS Messages We Send
BatchExchange.com sends the following categories of SMS messages to users who have opted in:
- Transactional Messages: Order confirmations, quote notifications, delivery updates, appointment reminders, and account alerts
- Project Updates: Status changes, schedule updates, and logistics notifications for active concrete projects
- Customer Service: Support responses, account security codes, and help messages
- Operational Notifications: Contractor match notifications, lead alerts for registered contractors and suppliers
3.3 SMS Data Sharing - Absolute Restriction
CARRIER COMPLIANCE STATEMENT: Mobile opt-in data, mobile phone numbers, and SMS consent information collected by BatchExchange.com will NOT be shared with or sold to third parties or affiliates for marketing or promotional purposes. This prohibition is absolute and applies at all times without exception.
To be explicitly clear:
- We DO NOT sell mobile phone numbers to any third parties
- We DO NOT share SMS opt-in consent data with data brokers or list aggregators
- We DO NOT share mobile numbers with third parties for use in their own SMS marketing campaigns
- We DO NOT rent or license mobile phone number lists to any external parties
- We DO NOT permit any third party to send SMS messages to our users using data obtained from BatchExchange.com
The only circumstances under which we may disclose mobile phone numbers to third parties are: (a) to Twilio or our authorized SMS service provider solely for the purpose of transmitting messages on our behalf, subject to contractual restrictions; or (b) in response to a valid legal subpoena, court order, or law enforcement request. SMS opt-in consent data and text messaging originator opt-in data are not shared, sold, rented, licensed, or transferred to third parties or affiliates for marketing or promotional purposes.
3.4 SMS Opt-Out Procedures
You may opt out of SMS messages from BatchExchange.com at any time using any of the following methods:
- Reply STOP to any SMS message (works with all opt-out keywords: STOP, QUIT, CANCEL, END, UNSUBSCRIBE)
- Email your opt-out request to admin@batchexchange.com
- Update notification preferences in your BatchExchange.com account settings
- Contact our support team at admin@batchexchange.com
After opting out, you will receive a single confirmation message. No further SMS messages will be sent unless you re-opt-in. Opting out of SMS does not affect your email communications or Platform access.

For assistance with our SMS program, reply HELP to any SMS message or contact admin@batchexchange.com. Carrier: BatchExchange uses Twilio as its SMS messaging provider. Supported carriers include AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, and regional carriers. Message and data rates may apply.
