3. SMS/Text Message Data - A2P 10DLC Specific Disclosures

The provisions in this Section 3 are required by U.S. mobile carriers under the A2P 10DLC framework and constitute our binding commitment to you regarding SMS data practices.

3.1 How We Collect SMS Opt-In Consent

We collect your mobile phone number and SMS consent through the following methods:

  • Online registration and account creation forms at BatchExchange.com
  • Lead submission and quote request forms on the Platform
  • In-person enrollment with a BatchExchange representative
  • Account settings and notification preference pages

At each opt-in point, we present: (a) clear disclosure that you are consenting to receive SMS messages; (b) the types of messages you will receive; (c) message frequency disclosure; (d) "Msg & data rates may apply" notice; (e) instructions for opting out; and (f) links to this Privacy Policy and our Terms of Service.

3.2 Types of SMS Messages We Send

BatchExchange.com sends the following categories of SMS messages to users who have opted in:

  • Transactional Messages: Order confirmations, quote notifications, delivery updates, appointment reminders, and account alerts

3.3 SMS Data Sharing - Absolute Restriction

CARRIER COMPLIANCE STATEMENT: Mobile opt-in data, mobile phone numbers, and SMS consent information collected by BatchExchange.com will NOT be shared with or sold to third parties or affiliates for marketing or promotional purposes. This prohibition is absolute and applies at all times without exception.

To be explicitly clear:

  • We DO NOT sell mobile phone numbers to any third parties
  • We DO NOT share SMS opt-in consent data with data brokers or list aggregators
  • We DO NOT share mobile numbers with third parties for use in their own SMS marketing campaigns
  • We DO NOT rent or license mobile phone number lists to any external parties
  • We DO NOT permit any third party to send SMS messages to our users using data obtained from BatchExchange.com

The only circumstances under which we may disclose mobile phone numbers to third parties are: (a) to Twilio or our authorized SMS service provider solely for the purpose of transmitting messages on our behalf; (b) in response to a valid legal subpoena, court order, or law enforcement request; or (c) in connection with a merger, acquisition, or sale of assets where the acquirer agrees to be bound by privacy terms no less protective than this Policy.

3.4 SMS Opt-Out Procedures

You may opt out of SMS messages from BatchExchange.com at any time using any of the following methods:

  • Reply STOP to any SMS message (works with all opt-out keywords: STOP, QUIT, CANCEL, END, UNSUBSCRIBE)
  • Email your opt-out request to admin@batchexchange.com
  • Update notification preferences in your BatchExchange.com account settings

After opting out, you will receive a single confirmation message. No further SMS messages will be sent unless you re-opt-in. Opting out of SMS does not affect your email communications or Platform access.

3.5 SMS Help

For assistance with our SMS program, reply HELP to any SMS message or contact admin@batchexchange.com. Carrier: BatchExchange uses Twilio as its SMS messaging provider. Supported carriers include AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, and regional carriers. Message and data rates may apply.

4. How We Share Your Information

4.1 With Concrete Contractors and Suppliers (Service Fulfillment)

When you submit a lead, project inquiry, or quote request, we share relevant information with registered BatchExchange contractors, suppliers, and concrete plants for the sole purpose of responding to your request. This includes your:

  • Name and contact information
  • Project location and specifications
  • Concrete type, quantity, and delivery requirements
  • Project timeline and budget parameters

Contractors and suppliers who receive your information through BatchExchange.com are contractually obligated to use it only to respond to your specific inquiry. They are prohibited from using your information for unrelated marketing or sharing it with unauthorized third parties.

4.2 With Service Providers

We share information with trusted service providers who assist us in operating the Platform, subject to confidentiality agreements and data processing restrictions:

  • Twilio - SMS and voice communications platform (DOES NOT use your data for third-party marketing)
  • Payment processors (e.g., Stripe) - for secure transaction processing
  • Cloud hosting providers - for Platform infrastructure
  • Email service providers - for transactional and marketing emails
