Contracts, quotes, deposits, remaining balances, cancellation terms, refunds, warranties, and contractor responsibilities are governed by the specific contract and quote terms presented to the customer before signature or payment.
Unless a different written rate is expressly approved in a signed change order, additional grading beyond 12 inches is billed at a minimum of $300.00 per hour. Such grading, excavation, or subgrade correction is outside the standard quoted concrete scope unless specifically included in writing.
Any additional material, site support, or job-preparation requirement that becomes necessary through no fault of BatchExchange LLC, including but not limited to additional dirt, bracing, fill material, excavation support, or similar supplemental jobsite needs, shall be at the homeowner's sole expense unless expressly included in writing in the original scope or an approved change order.
The homeowner is solely responsible for all permit-related pricing changes, county or municipal specification requirements, and any resulting scope, material, engineering, or compliance adjustments. BatchExchange LLC does not warrant that quoted materials or scope satisfy every local county specification unless those requirements were accurately disclosed and expressly incorporated in writing before deposit. By paying the deposit, the homeowner confirms that the submitted project information, site details, permit assumptions, and jurisdiction-specific requirements are complete and accurate. Any inaccurate, omitted, or changed information, details, specifications, or permit requirements are not the responsibility of BatchExchange LLC and may result in additional charges to the homeowner.
BatchExchange LLC reserves the right, in its sole discretion and to the fullest extent permitted by law, to revoke, reassign, redistribute, cancel, suspend, or otherwise modify any quote, contract, contractor assignment, marketplace routing, or related project arrangement at any time and for any reason, including but not limited to operational, compliance, safety, performance, availability, fraud-prevention, payment, or platform-integrity concerns.
Dealers and contractors each accept full responsibility, as separate independent businesses, for the acts, omissions, statements, conduct, access, misuse, negligence, and compliance failures of their respective owners, employees, agents, representatives, subcontractors, crews, office staff, or any other persons acting for them, employed by them, engaged by them, or granted access to the BatchExchange LLC platform through them or on their behalf.
Any reference to BX, Batchexchange, BatchExchange, BatchX, BatchEx, or any related BatchExchange LLC names, marks, branding, logos, imagery, or identifying materials refers solely to BatchExchange LLC and may be used only by or for BatchExchange LLC. Contractors, dealers, and other third parties do not represent BatchExchange LLC and are not authorized to hold themselves out as BatchExchange LLC unless expressly authorized in writing by BatchExchange LLC.
BatchExchange LLC is not responsible for claims involving bodily injury, personal injury, sickness, illness, death, dismemberment, disability, emotional distress, or other physical or mental harm involving the homeowner, contractor, subcontractors, guests, invitees, or affiliated parties arising out of project execution, site conditions, contractor means and methods, or third-party acts, except to the extent caused by BatchExchange LLC's own written obligations or gross negligence where such limitation is prohibited by law.
Any dispute, claim, action, or proceeding arising out of or relating to BatchExchange LLC, these Terms, the platform, or related services shall be handled exclusively in Surry County, North Carolina, to the fullest extent permitted by law.
As part of signing any contract delivered through BatchExchange LLC, the undersigned customer identified on the contract acknowledges that they have reviewed the agreement and expressly understand and agree to all applicable terms and conditions.
